Terms of Service

Please read these Terms of Service ("Terms", "ToS") carefully before using the Budget AI mobile application ("App", "Application", "Service") provided by Budget AI ("Developer", "Company", "We", "Us", "Our"). By downloading, installing, accessing, or using the App, you automatically agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.
1. Acceptance of Terms
By installing, accessing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. You represent and warrant that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into this agreement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. License and Use Restrictions
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Circumvent, disable, or interfere with security-related features of the App
- Use the App to infringe on the rights of any third party
- Interfere with or disrupt the operation of the App or any servers or networks connected to the App
- Use automated systems, bots, scripts, or other means to access the App or its features
- Attempt to gain unauthorized access to any portion of the App or its related systems
- Use the App in any manner that could damage, disable, overburden, or impair the Service
- Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, or create derivative works from the App
- Share, sell, rent, lease, or otherwise transfer your account or subscription to any third party
Users are responsible for the accuracy and legality of all data entered into the App. The App is a financial tracking tool and does not provide financial, investment, tax, or legal advice.
3. Data Storage Options
The App offers different data storage options depending on your preferences:
- Local Storage: By default, all your financial data is stored locally on your device. The Developer has no access to locally stored data and is not responsible for data loss due to device failure, theft, damage, uninstallation, or any other cause.
- Cloud Sync: You may optionally enable cloud synchronization using Appwrite's cloud infrastructure. When you create an account, your data is stored securely using industry-standard encryption. Cloud sync is provided "as is" and the Developer does not guarantee uninterrupted access or data integrity.
You are solely responsible for maintaining backups of your data. The Developer is not liable for any data loss, corruption, or unauthorized access, regardless of the storage method chosen.
4. Subscription-Based Services
The App offers subscription-based services with different tiers:
- Free Tier: Includes limited functionality with advertisements. Features may include restrictions on number of accounts, categories, transactions, AI requests, and access to historical data.
- Premium Tier: Provides enhanced functionality, removes advertisements, and includes additional features. Specific features and limitations are described in the App and may change at any time.
The Developer reserves the right to modify, limit, or discontinue any features of any subscription tier at any time, with or without notice. The Developer may introduce new tiers, modify existing tiers, or change the features included in each tier at its sole discretion.
5. Pricing, Payment, and Renewal
- Subscription-based services are auto-renewable and may be billed monthly or yearly
- Yearly subscriptions may offer a discounted price compared to monthly subscriptions
- Subscription prices are specified in the Application Store and are subject to change at the Developer's discretion
- Prices may not include applicable taxes, which vary by region
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
- You may cancel your subscription at any time via your Application Store account settings
- Upon cancellation, access to Premium features remains available until the end of the current billing period
- Payments are processed through the Application Store; we do not store or process your payment information
- All subscription payments are non-refundable, except as required by law or the policies of the Application Store
- Refunds, if applicable, are handled according to the respective app store policies (Apple App Store or Google Play Store)
6. AI Services, Voice Input, Image Input, and Usage Limits
The App provides AI-powered features including voice input processing, image processing, and transaction categorization. These features are subject to the following terms:
6.1 Voice Input Processing
- Voice input features use speech recognition to transcribe your voice into text
- Transcription may be performed locally on your device or via third-party services
- AI services (including but not limited to OpenAI, OpenRouter, or local LLM) are used to interpret and categorize transactions from voice input
- AI interpretation may not always be accurate; users must verify all transactions created via voice input
- Voice recordings are processed in real-time and are not stored by the Developer
- Microphone access is required for voice features and can be revoked in device settings at any time
6.2 Image Input Processing
- You may send images (e.g. photos of receipts, invoices, or other documents) for AI-powered analysis and transaction creation
- When you submit an image, it is transmitted to third-party AI services (such as OpenAI or OpenRouter) for processing
- AI services analyze the image to extract transaction details such as amounts, dates, descriptions, and categories
- AI interpretation of images may not always be accurate; users must verify all transactions created from image input
- Images are only sent when you explicitly initiate the action; the App does not automatically send images without your consent
- The Developer does not permanently store images sent for AI processing
- Images sent to third-party AI services are subject to those services' data handling and retention policies (e.g. OpenAI may retain data for up to 30 days for abuse monitoring)
- Camera and/or photo library access is required for image features and can be revoked in device settings at any time
You are solely and entirely responsible for the content of any images you capture, select, and submit through the App. The Developer does not control, review, filter, or moderate images before they are transmitted to third-party AI services. By using image input features, you acknowledge and agree that:
- You voluntarily choose what to photograph and what to submit — the App does not force or automatically capture or send any images
- You bear full responsibility for ensuring that images do not contain sensitive, confidential, or private information that you do not wish to share with third-party AI service providers (such as full bank card numbers, PINs, passwords, identity documents, social security numbers, medical records, or any other confidential data)
- The Developer is not responsible for any privacy or confidentiality consequences arising from the content of images you choose to submit, including any exposure, processing, retention, or potential misuse of data contained in those images by third-party AI services
- You must not submit images containing personal information of third parties without their explicit consent
- Once an image is transmitted to a third-party AI service, it is governed by that service's privacy policy and data handling practices, which are outside the Developer's control
- The Developer strongly recommends that you only photograph and submit images strictly necessary for transaction processing (e.g. receipts) and crop or redact any unnecessary sensitive details before submission
6.3 User Responsibility for All Submitted Data
You are solely and entirely responsible for all data you provide, enter, speak, capture, select, and submit through the App, regardless of the input method (voice, text, image, or otherwise).
The Developer does not control, review, filter, or moderate any user-submitted data before it is processed or transmitted to third-party services. By using the App, you acknowledge and agree that:
- You voluntarily choose what data to provide — what to say via voice input, what to type, what to photograph, and what to submit. The App does not force or automatically submit any data without your action
- You bear full responsibility for ensuring that data you submit does not contain sensitive, confidential, or private information that you do not wish to share with third-party service providers
- The Developer is not responsible for any privacy, confidentiality, or security consequences arising from the content of any data you choose to submit through any input method, including any exposure, processing, retention, or potential misuse of that data by third-party services
- You must not submit data containing personal information of third parties without their explicit consent
- Once data is transmitted to a third-party service, it is governed by that service's privacy policy and data handling practices, which are outside the Developer's control
- You are responsible for verifying the accuracy of all data and transactions before and after submission
- The Developer strongly recommends that you only submit data strictly necessary for transaction processing and avoid providing sensitive personal information such as full bank card numbers, PINs, passwords, identity documents, social security numbers, medical records, or any other confidential data through any input method
6.4 Usage Limits and Fair Use
To ensure fair use and prevent abuse, the App implements reasonable limits on AI-powered features:
- Free Tier users are subject to daily and/or monthly limits on voice input requests and AI processing
- Premium Tier users may have higher limits but are still subject to fair use policies
- Specific limits are determined by the Developer and may be adjusted at any time without prior notice
- The Developer reserves the right to implement, modify, or remove usage limits at its sole discretion
- Exceeding usage limits may result in temporary or permanent restriction of AI features
6.5 AI Service Restrictions
The Developer reserves the right to restrict, suspend, or terminate access to AI-powered features at any time, for any reason, including but not limited to:
- Suspected abuse, fraud, or violation of these Terms
- Excessive usage that impacts service quality for other users
- Technical issues, maintenance, or service provider limitations
- Changes in third-party AI service availability or pricing
- Any other reason deemed necessary by the Developer to protect the Service or its users
The Developer is not obligated to provide any specific level of AI service availability and may discontinue AI features entirely at any time.
7. Service Availability and No Guarantees
THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OR GUARANTEES OF ANY KIND.
- The Developer does not guarantee that the Service will be available, uninterrupted, secure, or error-free at any time, including during your subscription period
- Service may be temporarily or permanently unavailable due to maintenance, updates, technical issues, third-party service outages, or any other reason
- The Developer does not guarantee any specific uptime, response time, or service level
- Features may be modified, limited, or removed without prior notice
- The Developer is not responsible for any losses arising from service unavailability or interruption
- Payment of subscription fees does not guarantee continuous access to the Service or any specific features
- The Developer may suspend or terminate the Service or any part thereof at any time, with or without notice
By using the App and purchasing a subscription, you acknowledge and accept that service availability is not guaranteed for any period, including the duration of your paid subscription.
8. Account Responsibilities
If you create an account or use cloud sync features, you are responsible for:
- Maintaining the confidentiality of your account credentials and password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Providing accurate and current account information
- Complying with all applicable laws and these Terms while using your account
You must not share your account credentials with others or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.
9. Third-Party Services
The App utilizes third-party services that have their own Terms and Conditions:
- Sentry - Error tracking and performance monitoring
- PostHog - Product analytics
- Google AdMob - Advertising services
- Appwrite - Backend services and cloud infrastructure
- OpenAI - AI processing services
- OpenRouter - AI model routing service
- DigitalOcean - Cloud infrastructure
The Developer is not responsible for any service interruptions, data loss, security breaches, or other issues caused by third-party service providers. Third-party services are subject to their own terms and conditions, and the Developer makes no representations or warranties regarding their availability, accuracy, or reliability.
Once your data (including text, voice transcriptions, images, and any other content) is transmitted to a third-party service, it is governed solely by that service's terms and privacy policy. The Developer has no control over and assumes no responsibility for how third-party services process, store, retain, secure, or use your data. You use the App and its integration with third-party services at your own risk.
10. App Store Terms
The App is subject to the standard terms and conditions set forth by the respective app stores:
- For iOS users: Apple App Store Terms and Conditions
- For Android users: Google Play Store Terms of Service
By downloading or using the App, you acknowledge that you have reviewed and agreed to the Application Store's terms of service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER ASSUMES NO LIABILITY WHATSOEVER:
- The Developer shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or any other damages arising out of or relating to the use or inability to use the App
- The Developer shall not be liable for any loss of profits, revenue, data, use, goodwill, business opportunities, or other intangible or tangible losses
- The Developer does not guarantee the accuracy, completeness, reliability, or availability of any information, features, or services provided by the App
- In no event shall the Developer have any liability to you or any third party for any reason whatsoever, regardless of the form of action or legal theory
- You expressly understand and agree that you use the App at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy, and effort is with you
The App is a tool for personal finance tracking only. Users are solely responsible for their financial decisions. The Developer is not responsible for:
- Any financial decisions made based on App data or AI-generated suggestions
- Data loss due to device failure, theft, uninstallation, cloud service issues, or any other causes
- Service interruptions, errors, or unavailability of the App or any features
- Inaccuracies in AI-generated categorizations, interpretations, or suggestions (whether from voice or image input)
- Unauthorized access to your account or data
- Actions taken by third-party service providers
- Any damages resulting from your reliance on the App or its features
- Any privacy, confidentiality, or security consequences arising from any data (including voice input, text, images, transaction details, or any other content) you voluntarily choose to provide, enter, capture, select, and submit through the App
- Any processing, retention, or use of your submitted data by third-party service providers in accordance with their own policies
- Any data breach, unauthorized access, data loss, or any other privacy or security incident occurring on the side of any third-party service provider
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND.
The Developer expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Any implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranties that the App will meet your requirements or achieve intended results
- Any warranties that the App will be compatible or work with other software, services, or devices
- Any warranties that the App will operate without interruption, be secure, or be error-free
- Any warranties regarding performance, reliability, or accuracy of the App or its features
- Any warranties regarding the security, privacy, or confidentiality of data you submit through the App, including data processed by third-party services
- Any warranties regarding the actions, policies, or practices of third-party service providers used by the App
No method of electronic transmission or storage is 100% secure. The Developer cannot guarantee absolute security of your data and expressly disclaims any warranty that your data will be secure from unauthorized access, breach, or loss, whether stored locally, in the cloud, or processed by third-party services.
13. Intellectual Property
The App, including all its content, features, functionality, design, graphics, and code, is owned by the Developer and is protected by intellectual property laws. Unauthorized copying, modification, distribution, or creation of derivative works is strictly prohibited. You acknowledge that you have no ownership or intellectual property rights in the App.
14. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation:
- Breach of these Terms
- Suspected fraud, abuse, or illegal activity
- Excessive usage or violation of fair use policies
- Request by law enforcement or government agencies
- Discontinuation or material modification of the Service
- Technical or security issues
- Any other reason at our sole discretion
Upon termination, your right to use the App will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Force Majeure
The Developer shall not be held responsible for any failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor conditions, power failures, internet disturbances, hardware or software failures, third-party service outages, natural disasters, pandemics, or government actions.
Additionally, the Developer is not liable for any loss of data resulting from actions taken by the user, including but not limited to deletion of app data, device reset, or uninstallation of the App.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Developer, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use of and access to the App
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any applicable laws or regulations
- Any content or data you submit or transmit through the App, including but not limited to voice input, text, images, transaction details, and any other data sent for processing
- Any claims arising from the content of data you voluntarily submitted to third-party services through the App, regardless of the input method
- Any claims related to the privacy, confidentiality, or security of data you chose to provide through the App
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is legally registered, without regard to its conflict of law provisions. Any legal disputes or claims arising from the use of the App shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
In the event of a legal dispute, the parties agree to first attempt to resolve the matter through good-faith negotiations. If an amicable resolution cannot be reached, the dispute shall be submitted to binding arbitration conducted by a mutually agreed-upon arbitrator.
18. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be resolved through negotiation and, if required, through binding arbitration. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
19. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by the Developer, constitute the entire agreement between you and the Developer regarding the use of the App. These Terms supersede any prior agreements or understandings.
21. Changes to Terms
The Developer reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will notify users of significant changes through the App or by updating this page. Your continued use of the App after changes constitutes acceptance of the new Terms. You are advised to review these Terms periodically for any changes.
